Nepal Police: Can’t extradite Kanpur derailment ‘mastermind’ Hoda to India

Nepal’s Police says it can’t extradite Shamshul Hoda, a Nepali national who is a prime suspect in the November 2016 Kanpur derailment that killed over 150 people.

Hoda, who was arrested in Kathmandu after he arrived from Dubai this week, also faces murder charges in Nepal. Local police say they are investigating the murder of Arun and Dipak Ram in Nepal’s Bara district.

“We do not have an extradition treaty with India, and there are no legal provisions for extraditing a Nepali national to India, or the other way round,” Nepal Police’s Special Bureau chief DIG BaM Bahadur Bhandari told Onlinekhabar.

Bara district court has already granted permission to police to remand Hoda in custody for investigation.

Meanwhile, Indian media reports say the National Investigation Agency wants Hoda extradited. Agency officers are also preparing to come to Nepal to question Hoda on the train derailment and other incidents linked with him. Indian officials also believe that Hoda was working for Pakistan’s spy agency ISI.
