Kathmandu, February 12
District Court Kathmandu‘s Judge Yagya Prasad Acharya has been transferred to Mugu on deputation. Judge Acharya is responsible for ordering the release of businessperson Arun Chaudhary and two others amidst the case of embezzlement of land associated with the Bansbari Leather and Shoes Factory.
Chief Justice Bishwombhar Prasad Shrestha has transferred him to Mugu District Court. According to Shrestha, Judge Acharya’s bench was not following the valid principles of justice to release them, when they were presented to the court for an extension of time for investigation. This might create a situation for the release of other accused of similar cases.
Ajit Narayan Singh Thapa and Sanjay Thakur were the other two in custody who got bailed.
In the full meeting of the Supreme Court, some judges raised serious questions about the execution of his order.
Judge Acharya’s bench ordered that the situation in the case does not demand investigation keeping them in custody for 25 days and if the police needed to investigate the case, the police could keep them for two days and complete the investigation.
The Judicial Council, overseen by the Chief Justice, is responsible for transferring judges, but the Chief Justice has the authority to personally transfer them on deputation.
