Kathmandu, January 5
The Prachanda government has decided to receive the report of the Local Level Restructuring Commission.
LLRC officials had wanted to submit the report about two weeks ago. Prime Minister Prachanda, however, had hesitated to receive it, pointing that political parties were discussing whether to conduct elections for local bodies or for local levels.
The government was in a dilemma as acceptance of the report would mean automatic dissolution of existing local bodies as per Article 303 of the Constitution.
The article states that local bodies that were in existence during promulgation of the Constitution will remain in existence till authorities fix the number and jurisdictions of local levels.
But Thursday’s meeting of the Council of Ministers decided to receive the report. A minister told Onlinekhabar: The government has the authority to check whether the commission has prepared the report as per its terms of reference. The government will not implement the report if it finds that it has violated the ToR.
The meeting also discussed jurisdictions of states, provinces and local levels. A team under Chief Secretary prepared and submitted the list of rights that these units are entitled to.
The Cabinet decided to forward the report to the Economic Infrastructure Committee for further discussions.
