A writ filed by the former managing director of Nepal Electricity Authority Hitendra Dev Shakya, demanding to be reinstated in the position instead of Kulman Ghising, has reached a single bench of justice Kumar Regmi.
In the writ, Shakya has claimed that his removal from the position was unlawful. He has demanded to be reinstated in the position while dismissing Ghising’s appointment.
Shakya also said that he has not resigned from the said position.
The office of Prime Minister and council of ministers, Ministry of Energy, Minister for Energy Pampha Bhusal, Nepal Electricity Authority Operation committee and incumbent MD of NEA Kulman Ghising are the defendants in Shakya’s writ.
The writ was filed on Monday, August 16.
Prime Minister Sher Bahadur Deuba appointed Ghising to the said position, and he took over the position on August 11. Meanwhile, Shakya was sent to the Water and Energy Commission as its secretary for a four-year term as the secretary-equivalent official.
Ghising served for four years as NEA’s MD before he had to retire in September 2020 as the KP Sharma Oli-led government did not reappoint him despite a wide demand.
Shakya, previously. had said he was ready to get a new role but not to be sacked as a punishment. He had also warned he would launch a legal battle if the government removed him without giving him any respectful role.
