Although the Election Commission has claimed it will settle the dispute between two factions of the split Nepal Communist Party by deciding which side is legitimate as soon as possible, the process will take as many as three months as per related laws.
Here is a brief description of the set process and time allocated for each step as per the Act on Political Parties.
- As the Dahal-Nepal faction has officially reached the commission claiming its hold over the party’s name, election symbol, flag and other properties, the constitutional body now needs to inform the other (Oli’s) side about that. The other side will be told to submit its defence to the commission within 15 days. However, if the faction requests for an extension, the commission can grant a 10-day extension. It means it will take a maximum of 25 days.
- The commission will then summon both the parties and ask them to reconcile.
- The law has it that the commission should give a verdict on the dispute within 45 days since the submission of the response from the defending party or the end of the deadline for the submission.
- The commission officials say it might take as long as 90 days to complete the process altogether.
