Sources close to Subas Chandra Nembang, a close aide of Prime Minister KP Sharma Oli, say the chairman of the then Constituent Assembly that drafted the 2015 constitution is also not confident about the constitutionality of Oli’s decision to dissolve the House of Representatives.
A source quotes Nembang as saying, “Whatever has been spread about my statement that the prime minister does not have a right to dissolve the parliament is undisputable. I do not deviate from my previous statement.”
“I have spoken about this issue a lot more than what people are talking about these days. But, I do not speak about this issue publicly now.”
Nonetheless, the leader blames the dissident faction of the NCP led by Pushpa Kamal Dahal and Madhav Kumar Nepal for triggering the dissolution of the House.
“Maybe the prime minister developed a distrust of the leaders after they went to the president with the signatures of the lawmakers [demanding a special session of the House] without informing him.”
It has been learned that Oli had repeatedly consulted Nembang about the constitutionality of the dissolution before he made the decision, and Nembang had advised against it every time.
Now, he says it is not him but the Supreme Court decides the constitutionality of the move.
