Prime Minister KP Sharma Oli has been accused of ‘secretly’ taking back the original copy of the cabinet’s decision about the dissolution of the House of Representatives that he had submitted to the Supreme Court in response to the court order.
Lawyers advocating against Oli’s decision suspect the original copy was taken back in order to tamper with it because the decision, whose constitutionality has been questioned at the court, had not mentioned any article of the constitution. However, the President’s Office while endorsing the decision had mentioned articles 76 and 85 of the constitution.
As the court’s constitutional bench led by Chief Justice Cholendra Shamsher Rana heard the petitions filed against the decision on Friday, senior advocate Raman Shrestha raised concerns over the withdrawal of the document. Responding to him, Chief Justice Rana at first denied the claim saying there was no provision of taking back such document.
However, upon immediate investigation, it was found that the Office of the Prime Minister and Council of Ministers took back the decision on January 7. The OPMCM had assured to send back the decision on January 12, but it has reached the court again yet.
