Supreme Court orders PSC to let coronavirus positives attend exams

Kathmandu, October 15

The Supreme Court has ordered the Public Service Commission to let people testing positive for the novel coronavirus also attend its exams.

A single bench of Justice Sapana Pradhan Malla issued an interim order not to implement the point 8.1 of the commission’s standard set for conducting the exams during the pandemic. The point required the examinees to self-declare they are not infected with the virus.

Hearing a writ petition filed against the commission’s decision, the court today said the decision was against the fundamental rights to employment, equality, and non-discrimination.

Further, such a requirement might put pressure on some coronavirus-positive candidates to declare themselves as negatives and it could spread the infection among others, says the court order.

Meanwhile, the court told the constitutional body to ensure a safe environment to conduct examinations that also respects people’s privacy and dignity.
