The Supreme Court has rejected a habeas corpus petition seeking the release of medical entrepreneur Durga Prasai, who was arrested on charges of electronic crime.
The petition, filed by his son Nirajan Prasai, claimed that Durga Prasai was being detained unlawfully. However, a joint bench of Justices Nityananda Pandey and Mahesh Sharma Paudel dismissed the plea on Wednesday and issued a directive order.
The petition named the Ministry of Home Affairs as one of the respondents. After hearing the case, the Supreme Court upheld the ongoing investigation, allowing Prasai to remain in custody.
Durga Prasai was arrested on November 19 after a controversial video surfaced in which he alleged that former Prime Minister KP Sharma Oli had invested in Cambodia.
Nirajan Prasai filed the habeas corpus petition on November 24, listing the Ministry of Home Affairs, the Nepal Police Headquarters in Naxal, the Central Investigation Bureau (CIB) in Lazimpat, and the Kathmandu District Court as respondents.
The police, with permission from the Kathmandu District Court, are holding Durga Prasai in custody for investigation into allegations of cybercrime and forgery of government documents, among other charges.
