SC refuses to issue interim order against Charter Amendment Bill

The Supreme Court did not issue an interim order in response to a writ petition against the government-sponsored Constitution Amendment Bill. This has paved the way for pushing the amendment process ahead and put pressure on opposition parties, including the main opposition CPN-UML, to remove obstructions in the Parliament.

The apex court has issued a lengthy ruling, referring to Article 274, among others. The court has indicated it may refuse to recognise any amendment that is against the spirit of the Constitution.

The petitionres had filed the writ after the government registered the Bill in the Parliament. After conducting an initial hearing on the writ, a single bench of justice Jagdish Prasad Sharma had wanted to know from the government the motives behind the registration of the amendment proposal.

After the defendants’ responded, a bench of Chief Justice Sushila Karki and justice Ishwar Prasad Khatiwada had initiated a hearing on Sunday.
